Terms of Service

By accessing or using the Dinnerbell LLC website, platform, or services ('Services'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree, you may not use the Services.

DinnerBell operates as a technology marketplace that connects customers with independent local delivery contractors. DinnerBell is not a restaurant, food provider, seller of restaurant goods, or food-preparation business. Customers place restaurant orders directly with restaurants or merchants, and restaurants remain responsible for menu items, food preparation, pricing, quality, availability, and fulfillment of restaurant goods.

Drivers using the DinnerBell platform are independent contractors. They are not employees, agents, partners, joint venturers, or representatives of Dinnerbell LLC. Drivers choose whether to accept delivery opportunities and remain responsible for their own taxes, insurance, vehicle expenses, fuel, equipment, licenses, permits, and compliance with applicable laws.

Drivers may determine their own delivery pricing, including flat delivery amounts and mileage rates. DinnerBell retains a twenty percent (20%) platform fee from completed marketplace transactions. Platform fees support hosting, dispatch, payment processing, fraud prevention, support, administration, development, notifications, mapping, verification, and other platform operations.

Customer pricing may vary based on contractor decisions, distance, demand, time, availability, route conditions, and other operational factors. DinnerBell does not guarantee that any specific driver, delivery price, delivery time, or pricing level will be available.

DinnerBell facilitates delivery requests within its operating area. Requests outside the current operating area are subject to review and are not guaranteed. Delivery is deemed complete when the order is delivered to the address provided by the customer or otherwise confirmed delivered in accordance with platform procedures. Customers are responsible for providing accurate pickup, drop-off, contact, and order information.

Delivery times, route estimates, driver availability, and ETAs are estimates only and are not guaranteed. DinnerBell is not responsible for delays caused by restaurant operations, traffic, weather, road conditions, customer delay, technology issues, payment issues, or driver availability. If no driver is secured for a request, the request may be cancelled, timed out, or handled according to the refund and credit policy below.

DinnerBell generally does not issue cash refunds. Approved adjustments are issued as DinnerBell Account Credits unless otherwise required by applicable law. If no driver is secured for a request, or if a customer cancels before driver assignment, the customer will receive a 100% DinnerBell Account Credit for eligible amounts paid. If a customer cancels after a driver has been assigned or has begun work, DinnerBell may reduce, deny, or partially issue credits depending on work already performed.

If a restaurant is closed or unable to fulfill a request, DinnerBell may issue a full or partial DinnerBell Account Credit after review. Missing items, delays, quality concerns, communication issues, and other service complaints are reviewed individually, and credits may be issued at DinnerBell's discretion. DinnerBell Account Credits do not expire unless a posted policy says otherwise.

DinnerBell reserves the right to deny credits, suspend accounts, restrict platform access, investigate claims, or terminate access for suspected fraud, abuse, false claims, chargeback misuse, repeated refund requests, referral abuse, or misrepresentation. Customers are encouraged to contact DinnerBell before initiating a chargeback. Abuse of the chargeback process may result in account restrictions or permanent removal from the platform.

By applying to drive or using the driver portal, each driver certifies that they are at least 18 years old, hold a valid driver's license, maintain valid vehicle insurance, have legal authority to work and contract, understand their independent contractor status, and are responsible for all tax obligations. Drivers agree to follow laws and regulations, maintain vehicle safety, protect customer information, and maintain required insurance.

DinnerBell may suspend or terminate driver platform access at its discretion. Driver agreement acceptance may be recorded by checkbox acceptance, typed legal name, timestamp, IP address, account ID, and related permanent acceptance records.

By creating an account, submitting a request, applying to drive, or using the platform, users consent to transactional emails, delivery status messages, account notifications, dispatch communications, and security alerts. Transactional messages are not marketing messages. Message and data rates may apply. Users are responsible for maintaining accurate contact information.

To the fullest extent permitted by law, Dinnerbell LLC's total liability shall not exceed the amount paid for the delivery service giving rise to the claim. Dinnerbell is not liable for indirect, incidental, or consequential damages.

Dinnerbell shall not be liable for failure to perform due to causes beyond its reasonable control, including natural disasters, government actions, severe weather, infrastructure failures, or other unforeseen events.

These Terms shall be governed by the laws of the State of Michigan.

Dinnerbell LLC reserves the right to modify or update these Terms at any time at its sole discretion. Updated Terms will be posted with a revised effective date. Continued use of the Services constitutes acceptance of the revised Terms.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. By creating an account, checking an acceptance box, typing a legal name, placing a request, applying to drive, or using the Services, you acknowledge that you have read, understood, and agree to these Terms.
